TriPlane Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TriPlane mobile application, website, and associated services ("TriPlane", "we", "our", or "us"). By accessing or using TriPlane, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

1. Eligibility

You must be at least 16 years old to use TriPlane. By using the service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. User Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity that occurs under your account.

3. Acceptable Use

By using TriPlane, you agree not to:

  • Violate any applicable laws or regulations;
  • Use the service for unlawful, harmful, or fraudulent purposes;
  • Access or attempt to access other users' data without permission;
  • Upload viruses, malware, spam, or other harmful content;
  • Reverse engineer, decompile, or interfere with the service’s operation.

4. Services Provided

TriPlane offers tools to plan, organise, and manage travel itineraries. The service includes AI-generated suggestions, destination ideas, and other features based on user input and data sources. These tools are provided for informational purposes only and are not intended as professional travel, legal, or financial advice.

TriPlane is not a travel agent, booking platform, or authorised intermediary. Any bookings, purchases, or decisions made based on information provided through the service are undertaken at your own discretion and risk.

5. Artificial Intelligence and Automation

Some content is generated using AI or automated systems. AI-generated information may be incomplete, outdated, or inaccurate. You agree not to rely solely on this content when making travel decisions, including bookings, visa requirements, or safety matters.

6. Personal Information and Data Use

TriPlane collects and processes personal information in accordance with our Privacy Policy and applicable data protection laws, including the GDPR and similar regimes. Personal data may include your name, email, travel preferences, and submitted content. You have the right to access, update, or delete your data at any time.

We do not sell personal information to third parties. Data may be stored on secure servers or locally within your browser or device to enhance performance and user experience.

7. Browser Storage

TriPlane may use client-side storage (such as local storage or session storage) to retain preferences, cache data, or support offline functionality. You may manage or clear stored data through your browser or device settings.

8. User Content

You may submit content including trip data, notes, or messages. By doing so, you grant us a limited, non-exclusive, worldwide, royalty-free licence to use, host, and display your content solely to operate and improve the service.

You must ensure your content does not violate any laws or the rights of others.

9. Intellectual Property

All TriPlane content, including software, designs, graphics, trademarks, and branding, remains the property of TriPlane or its licensors. You are granted a limited, revocable, non-exclusive licence to use the service for personal, non-commercial use in line with these Terms.

10. Third-Party Services

TriPlane may link to or integrate with third-party platforms such as mapping, booking, or transportation services. We do not control and are not responsible for the content, functionality, accuracy, or availability of those services. Use of third-party platforms is at your own risk and subject to their respective terms and policies.

TriPlane does not endorse or guarantee the reliability, quality, or suitability of any third-party provider or their services. You are solely responsible for evaluating and interacting with any third parties accessed via TriPlane.

11. Disclaimer of Warranties

TriPlane is provided "as is" and "as available". We make no warranties regarding the availability, accuracy, or reliability of the service. We do not guarantee uninterrupted access or that the service will be free from errors or defects.

11. Fees and Payment

Certain features or services offered by TriPlane may require payment, including subscription-based plans or one-time fees. All pricing will be clearly disclosed at the point of purchase and is subject to change with reasonable notice.

By submitting payment information, you authorise us and our third-party payment processor to charge the applicable fees to your designated payment method on a recurring basis (if applicable), including any applicable taxes, transaction fees, or currency conversion charges.

You are responsible for maintaining accurate billing information. Failure to provide valid payment details or to pay applicable fees when due may result in suspension or termination of access to paid features.

Unless otherwise stated, all payments are final and non-refundable, including for unused portions of a subscription period, partial use of services, or downgrades. Any refund or credit offered is at our sole discretion, unless required by law.

We reserve the right to change our pricing, billing structure, or features included in each plan at any time. If you are on a subscription plan, we will provide reasonable prior notice of any material changes to pricing or features that affect your account.

12. No Ownership or Partnership

Your use of TriPlane, including any paid subscription or access to premium features, does not grant you any ownership interest in the platform, its content, underlying technology, or associated intellectual property.

These Terms do not create any partnership, joint venture, agency, or employment relationship between you and TriPlane. All rights not expressly granted under these Terms are reserved by TriPlane.

13. Limitation of Liability

To the fullest extent permitted by law, TriPlane is not liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of anticipated savings, loss of business opportunity, loss of data, personal injury, property damage, or travel disruptions arising out of or in connection with your use of the service.

This applies whether the claim is based in contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

TriPlane does not warrant the accuracy, completeness, or reliability of any content or output, including AI-generated information, itinerary suggestions, or third-party data integrations. You are solely responsible for verifying all travel arrangements, bookings, legal requirements, and third-party services.

In no event shall TriPlane’s total aggregate liability to you, whether arising in contract, tort (including negligence), equity, statute, or otherwise, and whether as a free or paid user, exceed USD $1, regardless of the number or nature of claims made.

14. Indemnity

You agree to fully indemnify, defend, and hold harmless TriPlane, including its directors, officers, employees, contractors, affiliates, licensors, service providers, and agents (collectively, "Indemnified Parties") from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, expenses, fines, penalties, or settlements (including reasonable legal and accounting fees) arising out of or related to:

  • Your access to or use of the TriPlane service, whether as an individual user or on behalf of a business, organisation, or client;
  • Any content, data, or materials submitted or transmitted by you through the service, including travel plans, itinerary data, user-generated content, and personal information;
  • Any actual or alleged breach by you of these Terms or any applicable law, regulation, or third-party rights;
  • Any use of the service by your employees, agents, contractors, or representatives, where you are acting in a business or agency capacity;
  • Any failure to apply for, or to obtain, appropriate insurance, travel documents, visas, approvals, or confirmations in relation to itineraries or bookings made using TriPlane;
  • Any reliance placed by you or your clients, employees, or customers on AI-generated or automated content from TriPlane, including but not limited to misinterpretation, misuse, or omission;
  • Any loss, error, or disruption arising in connection with any third-party platform, integration, API, or service accessed through TriPlane;
  • Any disputes between you and third parties (including but not limited to clients, suppliers, or travel service providers) related to the use or output of TriPlane;
  • Any representation made by you, expressly or impliedly, that TriPlane is a travel agent, booking provider, or authorised representative of any third-party provider.

This clause applies whether the claim arises in contract, tort (including negligence), equity, statute, or otherwise.

This indemnity continues in full force and effect after the termination of your use of the service and applies whether you are using TriPlane as a private individual, sole trader, company, partnership, or on behalf of a third party. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence of any such matter.

15. Termination

We may suspend or terminate your access at any time without notice if you violate these Terms or use the service in a way that causes harm to others or to us.

16. Force Majeure

TriPlane is not liable for any delay or failure to perform due to circumstances beyond our reasonable control. These may include natural disasters, government actions, service outages, or acts of war.

In such events, TriPlane’s obligations under these Terms will be suspended for the duration of the event. We will make reasonable efforts to resume service as soon as possible.

17. Changes to These Terms

We may update these Terms occasionally. If changes are material, we will notify you via the service or email. Continued use after changes take effect means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of New South Wales, without reference to its conflicts of law principles.

20. Entire Agreement
